Brian Cummings is a partner at Hirschhaut & Schmidt, LLC. Having honed his craft for over a decade in both the public and private sectors, he has obtained extensive experience in all aspects of litigation, including trial. Brian now focuses his practice on the representation of design professional and business clients in complex and high-stakes cases. With an aggressive and meticulous approach, Brian strives to achieve his clients’ litigation objectives with efficiency and strategic clarity. He has implemented this philosophy in successfully resolving cases through dispositive motions, settlement, mediation, and arbitration.
Brian has been trusted to defend the interests and reputation of a wide range of professional and business clients. He has represented numerous professional clients – including architects, engineers, construction managers, doctors, nurses, police officers, judges, and elected officials – in cases arising from his clients’ professional duties. As lead defense counsel, Brian has successfully navigated his clients through wrongful death, paralysis, and catastrophic brain injury cases, defamation claims, and declaratory judgment suits involving regulatory issues. He has represented a regional financial institution in cases involving breach of contract, fraud, and real estate foreclosure. Recently, he successfully obtained injunctive relief on behalf of a national automotive retail and services provider. While Brian litigates a majority of his cases in the Circuit Court of Cook County, one of the most challenging jurisdictions for professional defendants in the country, he also has a depth of experience in both the federal and state courts across Illinois. This makes Brian a trusted local counsel for out-of-state attorneys.
As an Assistant Attorney General, Brian’s practice included representation of the Illinois Department of Transportation, the Capital Development Board, the Illinois State Police, the Illinois Department of Insurance, the Illinois Department of Central Management Services, the Governor, and the Secretary of State. He also has extensive experience representing insurance companies in complex coverage litigation, including matters involving asbestos and other mass torts, product liability, first-party fidelity policies, and third-party professional liability policies.
